These Odds API Early Access Terms (the "API Terms") apply to your use of the SmartStake Odds API (the "API"), including any API key we issue to you and any data you receive through the API (the "API Data"). They supplement our Terms and Conditions, which also apply to you. Where these API Terms conflict with the Terms and Conditions, these API Terms govern your use of the API.
By requesting, receiving or using an API key, you agree to these API Terms. If you are using the API on behalf of a company or other entity, you agree on its behalf and confirm that you have authority to do so.
1. Early access
The API is offered as an early-access program. Early access is free of charge until we tell you otherwise. We may change, add or remove endpoints, fields, books, leagues, limits and features at any time. We will try to give you notice before changes that are likely to break your integration, but we are not required to.
We may end the early-access program, or your participation in it, at any time. If we introduce paid plans, we will give you notice before any charge applies, and continued access after that point may require you to accept separate paid terms.
2. Your API key
Your API key is personal to you. You must keep it confidential and must not share, sell or publish it, or let anyone else use it. You are responsible for all use of the API made with your key. Tell us promptly at info@smartstake.ca if you believe your key has been exposed. We may rotate, suspend or revoke any key at any time.
3. What you may do
Subject to these API Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence during your participation in early access to:
- access the API with your key, within the limits we set;
- store, analyze and process API Data for your own internal purposes, including research, modelling, backtesting and building your own tools; and
- use API Data to train or evaluate your own models.
Your use of the API under these API Terms is our express written consent for the automated access the API provides, despite Section 7 of the Terms and Conditions. That consent covers the API only, not the SmartStake website or app.
4. What you may not do
You may not, and may not help anyone else to:
- sell, resell, sublicense, rent, publish or otherwise redistribute API Data, in raw or bulk form, to any third party;
- offer API Data, or anything substantially derived from it, through your own API, feed, data product or dataset;
- use the API or API Data to build or operate a product or service that competes with the API or with SmartStake;
- share your API key or let more than one person or organization use it;
- exceed or try to get around the rate limits, connection limits or other technical restrictions of the API, including by using several keys;
- access the API in a way that interferes with its operation or with other users; or
- use the API or API Data for any unlawful purpose.
If you want to use API Data in a way these API Terms do not allow, such as showing it to users of your own product, ask us first and we will let you know in writing whether and how you can.
5. Data and availability
API Data is gathered from sportsbooks, exchanges, prediction markets and other third-party sources. We do not own those sources and are not affiliated with any sportsbook. API Data may be delayed, incomplete or inaccurate, and odds shown through the API may not be available to you at a sportsbook.
The API and API Data are provided "as is" and "as available", without warranties of any kind. We do not guarantee uptime, latency, accuracy or completeness, and the API may be unavailable during maintenance or rebuilds of our data. Section 19 (Disclaimer) and Section 20 (Limitations of Liability) of the Terms and Conditions apply to the API and API Data.
6. Not betting advice
API Data is information only. It is not betting, financial or investment advice. Sports betting involves risk of loss. You are responsible for your own decisions and for complying with the laws that apply where you are. You must be at least 21 years old, or 19 in Canada, to use the API.
7. Usage and feedback
We log and monitor use of the API, including requests, connections and the volume of data delivered to each key, to operate, secure and improve it and to enforce these API Terms.
If you send us feedback or suggestions about the API, we may use them freely without any obligation to you.
8. Suspension and termination
We may suspend or end your access to the API at any time, with or without notice, including if we believe you have breached these API Terms. You may stop using the API at any time. When your access ends, you must stop using the API, and Section 4 continues to apply to any API Data you keep.
9. Changes to these API Terms
We may update these API Terms by posting a new version on this page and updating the date above. Your continued use of the API after an update means you accept the updated API Terms.
